QMUNITY respects the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit QMUNITY mobile application (the “Application”). Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION. We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy. By continuing to use our Application, you accept our use of privacy policy. You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Application after the date such revised Privacy Policy is posted. This Privacy Policy does not apply to the third-party online/mobile store from which you install the Application or make payments, including any in-game virtual items, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

Collection Of Your Information

We may collect, store and use the following kinds of data. The information we may collect via the Application depends on the content and materials you use, and includes:

Personal Data

Demographic and other personally identifiable information (such as your name, contact number, identification card number, email address, images, face data for facial recognition purpose) that you voluntarily give to us when choosing to participate in various activities related to the Application such as but not limited to creating a QMUNITY account, checking in to a location, giving feedbacks, and responding to surveys.

Derivative Data

Information our servers automatically collect when you access the Application, such as your native actions that are integral to the Application, including but not limited to liking, re-blogging, or replying to a post, as well as other interactions with the Application and other users via server log files.

Data from Social Networks

The Application may by default access your Facebook basic public account information, including your name, email, gender, birthday, current city, and profile picture URL, as well as other information that you choose to make public. Geo-Location Information

We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services.

Mobile Device Access and Data

We may request access or permission to certain features from your mobile device and device information such as your mobile device ID number, model, and manufacturer, version of your operating system, phone number, country, location, and any other data you choose to provide. If you wish to change our access or permissions, you may do so in your device’s settings.

Push Notifications

We may request to send you push notifications regarding your account or the Application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Data Security And Retention

The security of your Personal Data (such as your name, contact number, identification card number, email address, images, face data for facial recognition purpose) is important to us. We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. We endeavor to follow generally accepted industry standards to protect the Personal Data submitted to us, both during transmission and in storage. We maintain what we consider industry standard backup and archival systems. All data collected are stored in the Google server in Singapore due to higher security. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism. Although we work to protect the security of your account and other data including face data that we hold in our records, for example, by making good faith efforts to store Personal Data in a secure operating environment that is not open to the public, please be aware that no method of transmitting data over the Internet or storing data is completely secure. We cannot and do not guarantee the complete security of any data shared with us, and except as expressly required by law, we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content. If at any time during or after our relationship we believe that the security of your Personal Data may have been compromised, we may seek to notify you or the Third-Party User that provided us with your Personal Data of that development. If a notification is appropriate, we will endeavor to notify you or such Third-Party User as promptly as possible under the circumstances. If we have your email address, we may notify you by email to the most recent email address you have provided us in your account profile. Please keep your email address in your account up to date. If you receive a notice from us, you can print it to retain a copy of it. To receive these notices, you must check your email account using your computer or mobile device and email application software. You consent to our use of email as a means of such notification. We retain Personal Data about you for as long as you have an open account with us or as otherwise necessary to provide Services to you. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.

Use Of Your Information

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Application to:
- Assist law enforcement and respond to subpoena.
- Compile anonymous statistical data and analysis for use internally, the Malaysia Government or any other authorized governmental parties.
- Collected face data will be used for facial recognition purposes in the checking-in process of premises with installed camera and thermal scanner.
- Create and manage your account.
- Deliver targeted information regarding the Application to you.
- Email you regarding your account or any other relevant information.
- Generate a personal profile about you to make future visits to the Application more personalized.
- Increase the efficiency and operation of the Application.
- Monitor and analyze usage and trends to improve your experience with the Application.
- Notify you of updates to the Application.
- Offer new products, services, mobile applications, and/or recommendations to you.
- Prevent fraudulent transactions, monitor against theft, and protect against criminal activity.
- Request feedback and contact you about your use of the Application.
- Resolve disputes and troubleshoot problems.
- Respond to product and customer service requests.
- Solicit support for the Application.

Disclosure Of Your Information

We may share information we have collected about you in certain situations. Your information may be disclosed if we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information including face data information as permitted or required by any applicable law, rule, or regulation. This includes exchanging information with other entities for fraud protection and credit risk reduction. We may share your basic information with service providers for data analysis, email delivery and hosting services. We may share your information with the Government or our affiliates which include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us, in which case we will require those affiliates to honor this Privacy Policy. If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. You acknowledge that such transfers may occur and that the transferee may decline honor commitments we made in this Privacy Policy. We are not responsible for the actions of third parties with whom you share personal or sensitive data, and we have no authority to manage or control third-party solicitations. If you no longer wish to receive correspondence, emails or other communications from third parties, you are responsible for contacting the third party directly.

Third-Party Websites

The Application may contain links to third-party websites and applications of interest, including external services, that are not affiliated with us. Once you have used these links to leave the Application, any information you provide to these third parties is not covered by this Privacy Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services or applications that may be linked to or from the Application.

Policy For Children

We do not knowingly solicit information from children under the age of 13. If you become aware of any data we have collected from children under age 13, please contact us using the contact information provided below.

Account Information

You may at any time review or change the information in your account or terminate your account by logging into your account settings and updating your account or contacting us using the contact information provided.

Upon your request to terminate your account, we will delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

THE APPLICATION IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE APPLICATION AND OUR SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE APPLICATION AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TERMS OF USE

By downloading or using QMUNITY mobile application (the “Application”), these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the Application. You are not allowed to copy, or modify the Application, any part of the Application, or our trademarks in any way. You are not allowed to attempt to extract the source code of the Application, and you also should not try to translate the Application into other languages, or make derivative versions. The Application itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to QMUNITY.

QMUNITY is committed to ensuring that the Application is as useful and efficient as possible. For that reason, we reserve the right to make changes to the Application or to charge for its services, at any time and for any reason. We will never charge you for the Application or its services without making it clear to you exactly what you are paying for.

The Application stores and processes personal data that you have provided to us, in order to provide our Service. It is your responsibility to keep your phone and access to the Application secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Application would not work properly or at all.

You should be aware that there are certain things that QMUNITY will not take responsibility for. Certain functions of the Application will require the Application to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but QMUNITY cannot take responsibility for the Application not working at full functionality if you do not have access to Wi-Fi, and you do not have any of your data allowance left.

If you are using the Application outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the Application, or other third-party charges. In using the Application, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the Application, please be aware that we assume that you have received permission from the bill payer for using the Application.

Along the same lines, QMUNITY cannot take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can not turn it on to avail the Service, QMUNITY cannot accept responsibility.

With respect to QMUNITY’s responsibility for your use of the Application, when you’re using the Application, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. QMUNITY accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the Application.

At some point, we may wish to update the Application. The Application is currently available on iOS and Android – the requirements for system (and for any additional systems we decide to extend the availability of the Application to) may change, and you will need to download the updates if you want to keep using the Application. QMUNITY does not promise that it will always update the Application so that it is relevant to you and/or works with the iOS and Android versions that you have installed on your device. However, you promise to always accept updates to the Application when offered to you, we may also wish to stop providing the Application, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the Application, and (if needed) delete it from your device.

Changes To This Terms Of Use

We may update our Terms of Use from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms of Use on this page. These changes are effective immediately after they are posted on this page.
